Road Traffic Accidents


If you are unfortunate enough to suffer an injury (commonly known as whiplash) following a road traffic accident, which was not your fault, then you may be entitled to make a claim against the party who was at fault.

If you are a driver, cyclist or pedestrian who is injured because of someone else's fault, then you will be pursuing a compensation claim against the other party's insurance company.  Passengers who are injured will pursue a compensation claim against the driver of the other vehicle if they were at fault, or the driver of your vehicle and insurance company.

You can still pursue a personal injury claim for whiplash if the other party is uninsured or untraced i.e. if they have left the scene of an accident. A stolen vehicle which caused your accident may still be insured and we would investigate whether the insurance company will pay for your compensation claim. If not we will proceed through the Motor Insurers Bureau on your behalf.

To help your case, you should take names, addresses and telephone numbers of any witnesses to the accident and take photographs of the accident locus if possible. If the whiplash injury is caused in a Road Traffic Accident and the negligent driver has no valid insurance, leaves the scene or admits to driving a stolen vehicle, you should contact the Police immediately and report the incident.

We may be able to recover expenses such as private physiotherapy costs and loss of earnings, but it is important that receipts and other vouching documentation are retained. If appropriate we will organise private physiotherapy for you at no cost to you and arrange vehicle hire again at no cost to you.
