Should I settle my personal injury claim arising from a car accident directly with the other driverís insurance company?

21 September 2016

If you have been injured in a car accident that wasn't your fault, you may be contacted shortly after by the other driver's insurance company with an offer of compensation for your injuries. You may feel forced into accepting this offer as a result of the insurers constant calls or by even visiting your home.

We would strongly advise that you do not accept this offer before seeking specialized legal advice from your solicitor.

The third party insurance company only has its own interests in mind and will do everything possible to minimise the amount that they have to pay out to you. You should note that despite the impression you may be given, there is no rush to settle your claim as you have three years from the date of the accident in which to pursue a personal injury action.

After the accident you are entitled to speak with a solicitor of your own choice. You should access specialized legal advice as soon as possible so that you have a clear idea of your rights and the possible value of your personal injury claim. In our experience, clients who settle directly with the third party insurers have received compensation which is significantly less than the potential value of the claim. It is important to remember that if you settle your claim directly with the insurers, you may find that you do not recover as quickly or as fully as you expected. You cannot however go back to the insurers months or even years later and ask for more money. The benefits of obtaining expert legal advice include the fact that the full extent of your injuries will be explored and a final prognosis obtained, therefore the true value of your claim can be determined with confidence.

Our team of experienced specialist litigation solicitors at HHD Solicitors can help you achieve a better level of settlement. We will get you the maximum compensation possible for your injuries. Our first consultation is free and there is no obligation on you to pursue a claim. At our initial meeting we will discuss your injuries and any relevant medical history. We have access to a vast number of medical experts in all fields and can arrange for you to be medically examined within a short time frame. We can also put you in touch with a private physiotherapist which may avoid the long waiting lists for physiotherapy in your area.

If you have any questions about the above or would like to speak with a personal injury solicitor, call us for a free consultation on 02890770770 or by email carolinedunlop@hhdsolicitors.com.
