Birthing Injuries and Catastrophic Claims

Misdiagnosis / Delay in Diagnosis

Cosmetic Surgery Errors

Dental Negligence

Infection Cases Including MRSA

General Medical Negligence

Birthing Injuries

Birth injury and catastrophic claims can be extremely complex, not least because having a baby is a very emotional time and you may not recall all of what happened during delivery. Damage for example can occur to your child if excessive force is applied during delivery or there is a delay in performing a necessary caesarean section delivery, or if the delivery team fails to properly anticipate the size of a baby. We will obtain all of the medical notes and records, radiology and CTG tracings to assist the medical expert chosen in your case to prove negligence.

Medical Negligence Claims

We have experience of a wide range of successful birthing cases, including children who have severe cerebral palsy and ongoing care, educational  and medical support needs, shoulder dystocia cases, hip dysplasia cases and mothers who have suffered anal sphincter tears or damage to their bladder during operative deliveries. We have dealt with successful cases where diabetic mothers have not received the appropriate care during ante natal treatment or who have had birthing products retained following delivery which led to surgical removal. We will deal with your case in a sensitive and timely manner and we have female solicitors in our medical negligence team should you wish to deal with them directly.

Most children will qualify for legal aid even though the child's parents may have substantial income and assets as only the child's income, if any, is taken into account. We will complete the legal aid forms with you and submit them on your behalf.

Misdiagnosis / Delay in Diagnosis

Best practice treatment usually involves early diagnosis and if a doctor has failed through their negligence to diagnose the illness in a timely manner then compensation may be payable for the worsening of the illness. Many medical mistakes can lead to a delay in cancer diagnosis or diagnosis of an orthopaedic or serious injury which may deprive patients of the chance of better treatment and these include lost records, failing to realise the importance of a patient's complaints, treating a patient inappropriately, misreading x-rays, inaccurate test results or failing to refer a patient to a specialist.

Our specialist solicitors have experience of a wide variety of misdiagnosis cases, including cauda equina syndrome, macular degeneration of the retina, bladder cancer, pancreatic cancer, breast cancer, cervical cancer and many orthopaedic injuries such as 'brittle bones', rotator cuff tears and fractures.

Cosmetic Surgery Errors

The most common claims following cosmetic surgery are breast reduction operations resulting in unevenness or unexpected and unsightly scarring, liposuction resulting in perforation to the bowel or damage to other parts of the body such as facial scarring and liposuction procedures resulting in unacceptable scarring.

We have experience of successful cosmetic surgery claims and we’ve also dealt with claims where foreign matter such as drainage tubing has been retained within the body following a cosmetic procedure. Dental Negligence

No one enjoys visiting the dentist but when the treatment you receive is negligent the experience will be even more harrowing. The dental negligence may arise from treatment through the NHS or through a private treatment provider, it may have been medical or cosmetic - it makes no difference. If the treatment or intervention was either unnecessary or not provided to the standard expected by the dental profession then you may be entitled to bring a claim for dental negligence and receive compensation.

Infection cases including MRSA

A new strand of infection has now evolved which is resistant to the antibiotic drugs traditionally used to treat and cure infections. This new strand of infection is known as methicillan resistant staphylococcus aureus or MRSA. The elderly and ill are most at risk of catching the MRSA infection due to their immune systems being lower. Patients with drips or open wounds are especially vulnerable. Where a patient contracts MRSA whilst in hospital, due to negligent treatment by the hospital, this may give rise to a claim for medical negligence if it can be shown that the source of the infection was the hospital or clinic. This also applies to C Difficile after recent hospital outbreaks and other strains of infection including MSSA, methicillin sensitive staphylococcus aureus.

We have also experience of cases involving necrotising fasciitis and Group B Haem Strep being passed from mother to infant and causing cerebral palsy.
