Surviving Mesothelioma claim settled for £425,000

Our client worked as a joiner and a building contractor in various nursing homes and hospitals in Northern Ireland in the 1960s and 1970s where he was exposed to asbestos dust in the course of his work, including assisting fitters working on pipes where the lagging was broken.

When our client was exposed to the asbestos dust, the tiny fibers would become airborne and were easy to inhale, and subsequently decades later, our client was diagnosed with an asbestos disease. Unfortunately in this case our client was later diagnosed with malignant mesothelioma, which is a form of cancer. It is estimated by health professionals that about 2,500 people a year are diagnosed with mesothelioma.

A claim for damages was pursued against the medical trusts who previously employed our client by our Michael Hollywood, a partner who heads our asbestos team specialising in asbestos related claims.

Medical evidence in this case, namely the detailed medical reports from Consultant Respiratory Physicians, focused on the mesothelioma condition suffered by our client and the untimely reduction in life expectancy.  Michael Hollywood also included a financial claim for the household tasks that he previously undertook and also for the care needed to support his wife. This case in particular relied heavily upon the care expert who prepared a report on the occupational therapy needs of our client and adaptions to his home and care costs.

Our client’s claim successfully settled with £325,000.00 compensation received by our client and approximately £100,000 to the Compensation Recovery Unit Northern Ireland for medical and social security costs recovery.
