Case Study – Minor Siblings involved in a Road Traffic Accident awarded £4500 and £3000 for Personal Injuries

HHD solicitor: Katrina Lagan, Solicitor, specialising in personal injury claims

Settlements: £4,500 and £3,000

What happened:  Our minor clients were passengers in their mother’s car in January 2017 when they were hit from behind by another vehicle. The children were aged 9 and 3 at the time of the collision, with the oldest sibling suffering from Asperger’s Syndrome and Attention Deficit Disorder. The children were treated on scene by the Northern Ireland Ambulance Service.

How HHD solicitors helped: Letters of Claim were sent to the relevant insurers of the third party driver on behalf of the children and liability was quickly admitted. Our 9 year old client suffered injuries to his elbow and head, together with an Adjustment Disorder lasting 3 months and travel anxiety travel anxiety with a total recovery time of 12 months. His younger sister sustained injuries to her arm and chest and was also diagnosed with an Adjustment Disorder lasting 3 months and travel anxiety with a recovery time of 6 months. Both children were sent to a Consultant in Accident and Emergency Medicine and a Psychiatrist. The medical evidence was served on the insurance company and due to our experience in negotiating these types of cases, we were able to obtain offers of £4,500 and £3,000 respectively, together with our professional fees. These figures were approved by the District Judge at Minor Approval Hearings and the funds have been lodged with the Court Funds Office where they will remain until the children reach the age of 18.
